Good point. As we have the open boundary rule at the moment..... anglers do so at their own risk. Thanks.

Our club has the rule that if its not open to the public or you if you have to climb over a fence then you cannot fish that mark in club comps.

I assume your club will have insurance for members? It would be interesting making a claim if someone gets injured whilst trespassing.

If anglers fish, they do so at their own risk. Which includes crossing fences, gates, scaling tyne mouth, shields or perhaps a cliff boundaries. The club will not be held responsible for any of the above, so by fishing they are agreeing to those terms. And as I said at present.. there are no boundaries with regards to distance travelled and venues as long as they are back at the weigh in before 10.30.

For what it is worth I would get the legality of that statement checked mate. If people are paying to fish an organized club match if fear there may be some duty of care on the part of the club during that match.

It has been checked. And lads have kept to those rules for the last 20 years. If anyone on here has any further queries pop down to the club and have a chat.

Just a point to note, anglers are covered by liability of the club, however the club does not condone any angler that puts themselves at risk by means of trespassing or risking injury and will not be held responsible for actions pertaining to dangerous and reckless behaviour. The club has an open boundary. However if the angler puts themselves at risk and trespasses say Hendon docks which is a public no go area then the angler that chooses that course of action does so at their own risk according to club legislation and club angling rules.

I would bet this would be the case if anyone was to get injured and it ended up in court.

Well let's hope no one gets injured, as I personally would be like a bullet to help them as with any Cleadon member. That aside the club is doing great. Lads still pulling fish out. So less of the doom and gloom, Hendon is not the be and end all. Marsden is the daddy. Forgot to mention have a good one lads. Merry Christmas.

If I organise a competition and a competitor climbs over the pier gate, goes along to the end and gets washed off or if any competitor in my competition looses his life by getting knocked over in the street or having a heart attack during the competition or if the competitor decides to end it all by committing suicide by wading into the sea or by jumping off the cliffs or has any serious road, cliff, pier, rock end, natural causes doings or any accident whatsoever during the competition then I am not liable. How can I be held responsible for the actions of somebody else? I am not my brothers keeper. Just tell the insurance men to feck off.

.... furthermore afaik if you have got a 'club' ie a clubhouse then the organisers can only be held responsible for accidents occurring inside the clubhouse if they are found to be negligent. How can anybody (the organisers) be held responsible for anything that happens to any competitor outside the 'club' premises ??

I agree with you and its common sense.

I do however think a judge would disagree and if the club was seen to condone dangerous activities (fishing whilst trespassing) during their comps then they could be held liable. Its the way of the world and litigation society for you.

Its like if i cock up massively at work and someone gets seriously hurt my employer can be sued even though its not their fault and they knew nothing about what i was doing. Vicarious liability.
