      oh,

      i fortgot to mention the finder of the property has to make reasonable enquiries to trace its owner, otherwise its theft. simple as that!

      have you reported it as lost property to the police?

              if the bloke doesn't hand it back he wants his heed kicked in. what would he do if it was his gear, no doubt come on the forums asking if anyone has pulled it in

                  If someone knows FOR SURE that this lad pulled in this rod and reel - why not name him on this site - i read with interest on another thread where a bloke was named (without any proof,only the word of accuser) that he had offered a big fish for sale ,so "Matchman" could weigh it in at a comp !!!

                  so if its good enough for one thread ,why not this one

                  i personally agree with tonynufc - if he doesnt hand it back in ,kick his head in - or check his other gear and see if he is using any of the stuff pulled in

                          Before you kick this guys head in bear in mind that he may not have had time to drop it off at Rutherfords yet. Not everyone fishes on a daily basis so he may return it next time that he picks up his bait.
                          Then again he may decide to keep it in which case he needs to be confronted and persuaded to do the decent thing.

                              Sless there is no law to say its his that i am aware of. Its called theft by finding.The lad should have reported it to the police and if its not claimed within a certain time he can keep it.
                              Its not like it salvage from a shipwreck
                              No have a feeling the lads thought all his xmases came at once pulling in something like that.
                              When we were at training school (20 yrs ago)theft by finding was defined as something like-
                              If you are in the Metro and find a one pound coin on the floor what would you do with it. I would keep it because why hand it in at the lost property place. Two reasons.1) It is of such a low value who would report it lost in the first place 2) how could the owner prove it was his. So the definition of theft of the coin does not really fit.
                              Now if it was a pensioners bag with £100 in it--and you kept it it would be a different story.
                              No whoever is keeping that gear knows they are in the wrong.

                                I'm no legal expert, but I do know that the "Law of the Sea" differs somewhat from the "Law of the Land", and I think that anything recovered from the sea is the property of the finder. I'm not sure if this applies to stuff washed ashore. As far as I know the finder can offer the property back to whoever lost it (and ask a price for it if he wants to), but is under no legal obligation to do so.

                                I'm sure most of us would be only too willing to return any fishing gear if we pulled in a rod or something, if we could trace the owner ( I know I would make every effort!). I do wonder how many people bother to put their name or any kind of security marker on their rods, (I know I haven't), and whether this might prompt the conscience of anybody finding such gear.

                                I really hope you get your gear back & maybe if the bloke who found your stuff reads these forums he'll decide to do the decent thing.
